Native Americans]
Native Americans in the United States (also Indians, American Indians, First Americans, Indigenous Peoples, Aboriginal Peoples, Aboriginal Americans, Amerindians, Amerinds, or Original Americans) are those indigenous peoples within the territory that is now encompassed by the continental United States, and their descendants in modern times. This collective term encompasses a large number of distinct tribes, states, and ethnic groups, many of them still enduring as political communities. A comprehensive tribal list can be found under "Classification of Native Americans."
The U.S. states and several of the inhabited insular areas which do not form part of the continental U.S. territory also contain indigenous groups. These other indigenous peoples in the United States are not generally designated as "Native Americans". This includes groups such as the Alaska Natives (Inuit, Yupik, Aleut, etc.), Native Hawaiians (also known as Kanaka Māoli and Kanaka 'Oiwi), and various Pacific Islander peoples such as the Chamorros.

The Bering Strait Land Bridge theory
Based on anthropological and genetic evidence, most scientists believe that most Native Americans descend from people who migrated from Siberia across the Bering Land Bridge between 17,000 and 11,000 years ago, where the Bering Strait is today.
The exact epoch and route is still a matter of controversy.
It should be noted, however, that many Native Americans reject theories of modern anthropology, having their own traditional stories that offer accounts to their origins, which are seen only as folklore by the scientific community.
The primarily Siberian origin is widely regarded as the most likely, consisting of at least three separate migrations from Siberia to the Americas:
- The first wave, during the late Pleistocene, would be the forerunners of the Clovis and Folsom cultures, both hunting the abundant large mammals of the virgin continent. This wave eventually spread over the entire hemisphere, as far south as Tierra del Fuego and is believed to have reached the New World no later than 11,000 years ago.
- The second migration brought the ancestors of the Na-Dene peoples. They lived in Alaska and western Canada, but some migrated as far south as the Pacific Northwestern U.S. and the American Southwest, and would be ancestral to the Dene, Apaches and Navajos. This group is believed to have reached North America between 6,000 to 8,000 years ago.
- The third wave brought the ancestors of the Inuit, Yupik and Aleut peoples. They may have come by sea over the Bering Strait, after the land bridge had disappeared. They are believed to have reached Alaska as late as 3,000 years ago.
In recent years, molecular genetics studies have suggested as many as four distinct migrations from Asia. These studies also provide surprising evidence of smaller-scale, contemporaneous migrations from Europe, possibly by peoples who had adopted a lifestyle resembling that of Inuits and Yupiks during the last ice age.
While many Native American groups retained a nomadic or semi-nomadic lifestyle through the time of European occupation of the New World, in some regions, specifically in the Mississippi River valley of the United States, in Mexico, Central America, the Andes of South America, they built advanced civilizations with monumental architecture and large-scale organization into cities and states.
A recent (2004) study has claimed evidence which, if accepted, would extensively revise the timeline of human habitation in the Americas. At the Topper site on the Savannah River near Allendale, South Carolina, a team led by University of South Carolina archaeologist Dr. Albert Goodyear reported recovering what they claimed to be stone tool artifacts from strata considerably below that of Clovis culture remains. Using stratigraphy and charcoal material found with the artifacts, radiocarbon dating performed by the University of California at Irvine Laboratory dated these remains to be at least 50,000 years old. This would indicate the presence of humans well before the termination of the last glaciation. Other archaeologists have disputed the dating methodology employed, and have also questioned whether these "artifacts" are not in fact naturally-formed, rather than of human manufacture. Other recent claims for pre-Clovis artifacts have similarly been made in some South American sites. The notion of pre-Clovis habitation continues to be a subject of scholarly debate, and the issue has not yet been satisfactorily resolved.
Settling down
By 1500 B.C. many tribes had settled into small indigenous communities. In several regions temporary hunter-gatherer settlements were transformed into small permanent or semi-permanent settlements and villages, frequently established in the regions such as river valleys which were conducive to the raising of crops. Several such societies and communities over time intensified this practice of established settlements, and grew to support sizeable and concentrated populations. Examples include those of the Mississippian Culture and the Pueblo peoples (Anasazi). They constructed large and complex earthworks, and were particularly skilled at small stone sculptures and engravings on shell and copper. Agriculture was independently developed in what is now the eastern United States by 2500 B.C., based on the domestication of indigenous sunflower, squash and goosefoot. Eventually, in the last eleven hundred years, the Mexican crops of corn and beans were adapted to the shorter summers of eastern North American and replaced the indigenous crops.
The large pueblos, or villages, built on top of rocky talleland or mesas of Southwest around A.D. 700, were a complicated aggregate of family apartments. Towns were one large complex of buildings, with multistoried houses arranged around courtyards or plazas. Wooden ladders provided access to upper levels. Under the courtyards, subterranean kivas, or ceremonial structures, served as meeting rooms for religious societies.
While exhibiting widely divergent social, cultural, and artistic expressions, all Native American groups worked with materials available to them and employed social arrangements that augmented their means of subsistence and survival.
European colonization
Initial impacts
The European colonization of the Americas forever changed the lives and cultures of the Native Americans. In the 15th to 19th centuries, their populations were ravaged, by the privations of displacement, by disease, and in many cases by warfare with European groups and enslavement by them. The first Native American group encountered by Christopher Columbus, the 250,000 Island Arawaks more properly called Taino of Haiti Quiskaya, Cubanacan (Cuba) and Boriquen as Puerto Rico were known then, were enslaved. It is said that only 500 survived by the year 1550, and the group was considered extinct before 1650. Yet DNA studies show that the genetic contribution of the Taino to that region continues, and the mitochondrial DNA studies of the Taino are said to show relationships to the Northern Indigenous Nations, such as Inuit (Eskimo) and others.
In the 15th century Spaniards and other Europeans brought horses to the Americas. Some of these animals escaped and began to breed and increase their numbers in the wild. Ironically, the horse had originally evolved in the Americas, but the last American horses, were game for early hunters, and went extinct about 9000 years ago, just after the end of the last ice age. The re-introduction of the horse had a profound impact on Native American culture in the Great Plains of North America. This new mode of travel made it possible for some tribes to greatly expand their territories, exchange goods with neighboring tribes, and more easily capture game.
Europeans also brought diseases against which the Native Americans had no immunity. Chicken pox and measles, though common and rarely fatal among Europeans, often proved fatal to Native Americans, and more dangerous diseases such as smallpox were especially deadly to Native American populations. It is difficult to estimate the total percentage of the Native American population killed by these diseases. Epidemics often immediately followed European exploration, sometimes destroying entire villages. Some historians estimate that up to 80% of some Native populations may have died due to European diseases. For more information, see population history of American indigenous peoples.
Early relations
During the Seven Years' War many Native Americans sided with France although some did fight alongside the British.
During the American War of Independence, the newly proclaimed United States competed with the British for the allegiance of Native American nations east of the Mississippi River. Most Native Americans who joined the struggle sided with the British, hoping to use the war to halt colonial expansion onto American Indian land. Many native communities were divided over which side to support in the war. For the Iroquois Confederacy, the American Revolution resulted in civil war. Cherokees split into a neutral (or pro-American) faction and the anti-American Chickamaugas, led by Dragging Canoe. Many other communities were similarly divided.
Frontier warfare during the American Revolution was particularly brutal, and numerous atrocities were committed on both sides. Noncombatants of both races suffered greatly during the war, and villages and food supplies were frequently destroyed during military expeditions. The largest of these expeditions was the Sullivan Expedition of 1779, which destroyed more than 40 Iroquois villages in order to neutralize Iroquois raids in upstate New York. The expedition failed to have the desired effect: American Indian activity became even more determined.
Native Americans were stunned to learn that when the British made peace with the Americans in the Treaty of Paris (1783), the British had ceded a vast amount of American Indian territory to the United States without even informing their Indian allies. The United States initially treated the American Indians who had fought with the British as a conquered people who had lost their land. When this proved impossible to enforce (the Indians had lost the war on paper, not on the battlefield), the policy was abandoned. The United States was eager to expand, and the national government initially sought to do so only by purchasing Native American land in treaties. The states and settlers were frequently at odds with this policy.
Removal and reservations
Treaty of Paris (1783)
In the 19th century, the incessant Westward expansion of the United States incrementally compelled large numbers of Native Americans to resettle further west, sometimes by force, almost always reluctantly. Under President Andrew Jackson, Congress passed the Indian Removal Act of 1830, which authorized the President to conduct treaties to exchange Indian land east of the Mississippi River for lands west of the river. As many as 100,000 American Indians eventually relocated in the West as a result of this Indian Removal policy. In theory, relocation was supposed to be voluntary (and many Indians did remain in the East), but in practice great pressure was put on American Indian leaders to sign removal treaties. Arguably the most egregious violation of the stated intention of the removal policy was the Treaty of New Echota, which was signed by a dissident faction of Cherokees, but not the elected leadership. The treaty was brutally enforced by President Martin Van Buren, which resulted in the deaths of an estimated 4,000 Cherokees (mostly from disease) on the Trail of Tears.
Conflicts generally known as "Indian Wars" broke out between U.S. forces and many different tribes. Authorities entered numerous treaties during this period, but later abrogated many for various reasons. Well-known military engagements include the Native American victory at the Battle of Little Bighorn in 1876, and the massacre of Native Americans at Wounded Knee in 1890. On January 31, 1876 the United States government ordered all remaining Native Americans to move into reservations or reserves. This, together with the near-extinction of the American Bison which many tribes had lived on, set about the downturn of Prairie Culture that had developed around the use of the horse for hunting, travel and trading.
Prairie Culture
American policy toward Native Americans has been an evolving process. In the late nineteenth century reformers in efforts to "civilize" Indians adapted the practice of educating native children in Indian Boarding Schools. These schools, which were primarily run by Christians [http://www.authorsden.com/visit/viewarticle.asp?AuthorID=2616&id=7375], proved traumatic to Indian children, who were forbidden to speak their native languages, taught Christianity instead of their native religions and in numerous other ways forced to abandon their Indian identity[http://www.sacbee.com/static/archive/news/projects/native/day2_main.html] and adopt European-American culture. Current status
There are 563 Federally recognized tribal governments in the United States. The United States recognizes the right of these tribes to self-government and supports their tribal sovereignty and self-determination. These tribes possess the right to form their own government; to enforce laws, both civil and criminal; to tax; to establish membership; to license and regulate activities; to zone; and to exclude persons from tribal territories. Limitations on tribal powers of self-government include the same limitations applicable to states; for example, neither tribes nor states have the power to make war, engage in foreign relations, or coin money. In addition, there are a number of tribes that are recognized by individual states, but not by the federal government. The rights and benefits associated with state recognition vary from state to state.
Military defeat, cultural pressure, confinement on reservations, forced cultural assimilation, outlawing of native languages and culture, termination policies of the 1950s, and 1960s, and slavery have had deleterious effects on Native Americans' mental and physical health. Contemporary health problems include poverty, alcoholism, heart disease, diabetes, and New World Syndrome.
As recently as the 1970s, the Bureau of Indian Affairs was still actively pursuing a policy of "assimilation" [http://www.doiu.nbc.gov/orientation/bia2.cfm], the goal of which was to eliminate the reservations and steer Indians into mainstream U.S. culture. In the state of Virginia, Native Americans face a unique problem. Virginia has no federally recognized tribes, largely due to the work of one man, Walter Ashby Plecker. In 1912, Plecker became the first registrar of the state's Bureau of Vital Statistics, serving until 1946. An avowed white supremacist and fervent advocate of eugenics, Plecker believed that the state's Native Americans had been "mongrelized" with its African American population. A law passed by the state's General Assembly recognized only two races, "white" and "colored". Plecker pressured local governments into reclassifying all Native Americans in the state as "colored", leading to massive destruction of records on the state's Native American community.
African American
Even after his death, Plecker still haunts the state's Native American community. In order to receive federal recognition and the benefits it confers, tribes must prove their continuous existence since 1900. Plecker's policies have made it impossible for Virginia tribes to do so. The federal government, while aware of Plecker's destruction of records, has so far refused to bend on this bureaucratic requirement. A bill currently before U.S. Congress to ease this requirement has been favorably reported out of a key Senate committee, but faces strong opposition in the House from a Virginia member concerned that federal recognition could open the door to gambling in the state. In the early 21st century, Native American communities remain an enduring fixture on the United States landscape, in the American economy, and in the lives of Native Americans. Communities have consistently formed governments that administer services like firefighting, natural resource management, and law enforcement. Most Native American communities have established court systems to adjudicate matters related to local ordinances, and most also look to various forms of moral and social authority vested in traditional affiliations within the community. To address the housing needs of Native Americans, Congress passed the Native American Housing and Self Determination Act (NAHASDA) in 1996. This legislation replaced public housing, and other 1937 Housing Act programs directed towards Indian Housing Authorities, with a block grant program directed towards Tribes.
Gambling has become a leading industry. Casinos operated by many Native American governments in the United States are creating a stream of gambling revenue that some communities are beginning to use as leverage to build diversified economies. Native American communities have waged and prevailed in legal battles to assure recognition of rights to self-determination and to use of natural resources. Some of those rights, known as treaty rights are enumerated in early treaties signed with the young United States government. Tribal sovereignty has become a cornerstone of American jurisprudence, and at least on the surface, in national legislative policies. Although many Native American tribes have casinos, they are a source of conflict. Most tribes, especially small ones such as the Winnemem Wintu of Redding, California, feel that casinos and their proceeds destroy culture from the inside out. These tribes refuse to participate in the gaming industry.
Many of the smaller eastern tribes have been trying to gain official recognition of their tribal status. The recognition confers some benefits, including the right to label arts and crafts as Native American and they can apply for grants that are specifically reserved for Native Americans. But gaining recognition as a tribe is extremely difficult because of a Catch-22 in the process. To be established as a tribal groups, members have to submit extensive genealogical proof of tribal descent, yet in past years many Native Americans denied their Native American heritage, because it would have deprived them of many rights, such as the right of probate. The Waccamaw tribe and the Pee Dee tribe of South Carolina were granted official recognition February 17, 2005. Two other tribal applications were denied for lack of documentation.
According to 2003 United States Census Bureau estimates, a little over one third of the 2,786,652 Native Americans in the United States live in three states: California at 413,382, Arizona at 294,137 and Oklahoma at 279,559 [http://www.census.gov/popest/states/asrh/tables/SC-EST2003-04.pdf].
As of 2000, the largest tribes in the U.S. by population were Cherokee, Navajo, Choctaw, Sioux, Chippewa, Apache, Blackfeet, Iroquois, and Pueblo. In 2000 eight of ten Americans with Native American ancestry were of mixed blood. The Massachusetts legislature repealed a 330-year-old law that barred Native Americans from entering Boston on the 19th of May 2005.
Cultural aspects
Though cultural features, including language, garb, and customs vary enormously from one tribe to another, there are certain elements which are encountered frequently and shared by many tribes.
Early nomadic hunters forged stone weapons from around 10,000 years ago; as the age of metallurgy dawned, newer technologies were used and more efficient weapons produced. Prior to contact with Europeans, most tribes used similar weaponry. The most common implement were the bow and arrow, the war club, and the spear. Quality, material, and design varied widely.
Large mammals such as the mammoth were largely extinct by around 8,000 B.C., and the Native Americans were hunting their descendants, such as bison. The Great Plains tribes were still hunting the bison when they first encountered the Europeans. The acquisition of the horse and horsemanship from the Spanish in the 17th century greatly altered the natives' culture, changing the way in which these large creatures were hunted and making them a central feature of their lives.

Society
The Iroquois tribes, living around the Great Lakes and extending east and north, used strings or belts called wampum that served a dual function: the knots and beaded designs mnemonically chronicled tribal stories and legends, and further served as a medium of exchange and a unit of measure. The keepers of the articles were seen as tribal dignitaries.
Pueblo tribes crafted impressive items associated with their religious ceremonies. Kachina dancers wore elaborately painted and decorated masks as they ritually impersonated various ancestral spirits. Sculpture was not highly developed, but carved stone and wood fetishes were made for religious use. Superior weaving, embroided decorations, and rich dyes characterized the textile arts. Both turquoise and shell jewelry were created, as were high-quality pottery and formalized pictorial arts.
Navajo spirituality focused on the maintenance of a harmonious relationship with the spirit world, often achieved by ceremonial acts, usually incorporating sand paintings. The colors—made from sand, charcoal, cornmeal, and pollen—depicted specific spirits. These vivid, intricate, and colorful sand creations were erased at the end of the ceremony.
Religion
The most widespread religion at the present time is known as the Native American Church. It is a syncretistic church incorporating elements of native spiritual practice from a number of different tribes as well as symbolic elements from Christianity. Its main rite is the peyote ceremony. The church has had significant success in combatting many of the ills brought by colonization, such as alcoholism and crime. In the American Southwest, especially New Mexico, a syncretism between the Catholicism brought by Spanish missionaries and the native religion is common; the religious drums, chants, and dances of the Pueblo people are regularly part of Masses at Santa Fe's Saint Francis Cathedral.
Gender roles
Most Native American tribes had traditional gender roles. In some tribes, such as the Iroquois nation, social and clan relationships were matrilinear and matriarchal but several different systems were in use. Men hunted, traded and made war, while women cared for the young and the elderly, fashioned clothing and instruments and cured meat. The cradle board was used by mothers to carry their baby whilst working or traveling.
Music and art

Native American music is almost entirely monophonic, but there are notable exceptions. Traditional Native American music often includes drumming and/or the playing of rattles or other percussion instruments but little other instrumentation. Flutes and whistles made of wood, cane, or bone are also played, generally by individuals, but in former times also by large ensembles (as noted by Spanish conquistador de Soto). The tuning of these flutes is not precise and depends on the length of the wood used and the hand span of the intended player, but the finger holes are most often around a whole step apart and, at least in Northern California, a flute was not used if it turned out to have an interval close to a half step.
Performers with Native American parentage have occasionally appeared in American popular music, most notably Shania Twain (ethnically European, but raised by a First Nations adoptive father), Buffy Sainte-Marie, Robbie Robertson, Rita Coolidge, Wayne Newton, and Redbone (band). Some, such as John Trudell have used music to comment on life in Native America, and others, such as R. Carlos Nakai integrate traditional sounds with modern sounds in instrumental recordings. A variety of small and medium-sized recording companies offer an abundance of recent music by Native American performers young and old, ranging from pow-wow drum music to hard-driving rock-and-roll and rap.
The most widely practiced public musical form among Native Americans in the United States is that of the pow-wow. At pow-wows, such as the annual Gathering of Nations in Albuquerque, New Mexico, members of drum groups sit in a circle around a large drum. Drum groups play in unison while they sing in a native language and dancers in colorful regalia dance clockwise around the drum groups in the center. Familiar pow-wow songs include honor songs, intertribal songs, crow-hops, sneak-up songs, grass-dances, two-steps, welcome songs, going-home songs, and war songs. Most indigenous communities in the United States also maintain traditional songs and ceremonies, some of which are shared and practiced exclusively within the community. Native American art comprises a major category in the world art collection. Native American contributions include pottery, paintings, jewelry, weavings, sculptures, basketry, and carvings.

Artists have at times misrepresented themselves as having native parentage, most notably Johnny Cash, who traced his heritage to Scottish ancestors and admitted he fabricated a story that he was one-quarter Cherokee. The integrity of certain Native American artworks is now protected by an act of Congress that prohibits representation of art as Native American when it is not the product of an enrolled Native American artist.

Economy
Survival in the environments in which they lived defined the work of the native groups. The Inuit, or Eskimo, prepared and buried stocks of dried meat and fish. Pacific Northwest tribes crafted seafaring dugouts 40-50 feet long for fishing. Farmers in the Eastern Woodlands tended fields of maize with hoes and digging sticks, while their neighbors in the Southeast grew tobacco as well as food crops. On the Plains, some tribes engaged in agriculture but also planned buffalo hunts in which herds were efficiently driven over bluffs. Dwellers of the Southwest deserts hunted small animals and gathered acorns to grind into a flour with which they baked wafer-thin bread on top of heated stones. Some groups on the region's mesas developed irrigation techniques, and filled storehouses with grain as protection against the area's frequent droughts.
As these native peoples encountered European explorers and settlers and engaged in trade, they exchanged food, crafts, and furs for trinkets, blankets, iron, and steel implements, horses, firearms, and alcoholic beverages.

When Christopher Columbus arrived in the "New World", he described the people he encountered as Indians because he mistakenly believed that he had reached the islands known to Europeans as the Indies. Despite Columbus's mistake, the name Indian (or American Indian) stuck, and for centuries the native people of the Americas were collectively called Indians in America, and similar terms in Europe. The problem with this traditional term is that the peoples of India are, of course, also known as Indians.
Common usage in the U.S.
The term Native American was originally introduced in the United States by anthropologists as a more accurate term for the indigenous people of the Americas, as distinguished from the people of India. Because of the widespread acceptance of this newer term in and outside of academic circles, some people mistakenly believe that Indians was outdated or offensive. People from India (and their descendants) who are citizens of the United States are known as Indian Americans.
However, some American Indians have misgivings about the term Native American. Russell Means, a famous American Indian activist, opposes the term Native American because he believes it was imposed by the government without the consent of American Indians. [http://www.peaknet.net/~aardvark/means.html] Furthermore, some American Indians question the term Native American because, they argue, it serves to ease the conscience of "white America" with regard to past injustices done to American Indians by effectively eliminating "Indians" from the present. [http://www.allthingscherokee.com/atc_sub_culture_feat_events_070101.html] Still others (both Indians and non-Indians) argue that Native American is problematic because "native of" literally means "born in," so any person born in the Americas could be considered "native". However, very often the compound "Native American" will be capitalized in order to differentiate this intended meaning from others. Likewise, "native" (small 'n') can be further qualified by formulations such as "native-born" when the intended meaning is only to indicate place of birth or origin. However, neither of these two senses invalidates the other, so long as the intended sense is made clear by the context.

Nonetheless, most American Indians are comfortable with Indian, American Indian, and Native American, and the terms are now used interchangeably. Recently, the US Census introduced the "Asian Indian" category to more accurately sample the Indian American population. In practice, most Indian Americans and of course Indian nationals think of themselves as the "real" Indians. This guarantees that the terms & their usages will evolve over the next few decades.

Continental United StatesThe continental United States refers (except sometimes in federal law and regulations) to the largest part of the U.S. that makes up one single geographic unit (plus minor nearby islands. Specifically, this includes the District of Columbia and the 48 states that all border at least one other state; it excludes Alaska and Hawaii.
The continental United States can also be used in its more literal (and geographically accurate) sense to refer the part of the United States situated on the North American continent, thus excluding only Hawai'i but not the exclave of Alaska.
These 48 states and the District of Columbia are also referred to as:
- the contiguous states (occasionally meant to include the District of Columbia)
- the contiguous United States (abbreviated in various specialized contexts as "CONUS")
- the conterminous or coterminous states
Some places, because of their own location relative to the continental US, have their own unique labels for the contiguous states.
- In Hawaii, it is called "the mainland" or "the continent".
- In Alaska, long-time residents often simply call this area "Outside", as in "My brother went Outside to have heart surgery". Some Alaskans use the more familiar term "lower 48" (logical only from an "Alaskan-centric" perspective).
All of these have some shortcoming of logic, ambiguity, or excessive or deficient formality. In particular:
- no collection of states includes the District of Columbia.
- "conterminous" and "coterminous" are rare, somewhat technical words. In addition, they are more generally used in the sense of having fully coincident boundaries. That is, the County of Hawaii and the Island of Hawaii are conterminous, and the eastern border of Arizona is conterminous with the western border of New Mexico, but it is inaccurate to say that Arizona and New Mexico are "conterminous" without some such clarification.
- while Hawaii is not part of any continent, Alaska is clearly, like the contiguous states, part of North America, and excluding it from the "continental U.S." must be described as a misnomer.
It is sometimes objected that since, for example, Oregon and Maryland are neither "contiguous" nor "conterminous", that these words are inappropriate to describe the whole main area of the US. However, the phrase Contiguous United States is entirely in keeping with the general use of the word "contiguous", as in Long rows of contiguous houses or the contiguous colors of the rainbow. In addition, "conterminous" is occasionally used in the same broad sense, as in Allied species, whose ranges are separate but conterminous. In the case of the US states, the disambiguating word "separate" would not be necessary.)
Use in federal law
As the language of the Alaska Omnibus Act of 1959 makes apparent, the term was in use in U.S. federal law prior to then. It presumably dates from after the acquisition of Alaska in 1867, and probably from after the Spanish-American War and the annexation of Hawaii brought the U.S. its first off-continent possessions, both in 1898. Whatever else these terms may be, "continental United States" is a term defined in various federal laws, in different ways in different time periods; it is also defined in different ways at the same time, depending on whether the context was the IRS or not, during at least a period that began with Alaska statehood.

A state is an organized political community occupying a definite territory, having an organized government, and possessing internal and external sovereignty. Recognition of the state's claim to independence by other states, enabling it to enter into international agreements, is often important to the establishment of its statehood, although some theories do not make this a requirement - for instance, the Montevideo Convention. The "state" can also be defined in terms of domestic conditions, specifically, as conceptualized by Max Weber, "a state is a human community that (successfully) claims the monopoly of the legitimate use of physical force within a given territory." Introduction
The word "state" in contemporary parlance often means the "Westphalian state", in reference to the Peace of Westphalia of 1648. In this sense, the modern state is an entity that enjoys extensive autonomy in its domestic economic and social policy, largely free from interference from other states and powers. A number of modern commentators have claimed that we are experiencing the decline of the Westphalian state as the principal actor of the international system, pointing to economic, cultural, political, and technological changes in the world, such as globalization and the emergence of regional and supernational groupings such as the European Union.
The term "state" is also used to describe subnational territorial divisions within a federal system, as in the case of the United States of America. See state (law) and state (non-sovereign).
In common speech, the terms country, nation and state are casually used as synonyms, but in a more strict usage they are distinguished:
- country is the geographical area.
- nation designates a people (however, national and international both confusingly refer as well to matters pertaining to what are strictly states, as in "national capital", "international law").
- state refers to the government, and an entity in international law.
Currently, the entire land surface of the Earth is divided among the territories of the roughly two hundred states now existing, with the special case of Antarctica, a variety of disputed territories, and a number of areas where state power exists in theory, but not in practice (the most significant of these being Somalia and Iraq).
Etymology
The word "state" originates from the medieval state or throne upon which the head of state (usually a monarch) would sit. By process of metonymy, the word state became used to refer to both the head of state and the power entity he represented (though the former meaning has fallen out of use). A similar association of terms can today be seen in the practice of referring to government buildings as having authority, for example "The White House today released a press statement..."
Formation of the state
The birth of the state, in the broadest sense of the word, coincides with the rise of civilization. For most of the existence of the human species, people lived as nomadic hunter-gatherers. That lifestyle began to change with the invention of agriculture around the 9th millennium BC. The practice of agriculture made it necessary for human beings to build permanent settlements and spend most of their lives in close proximity to the land they cultivated. Thus, control over land became an issue for the first time. To express that control, various forms of property rights developed, with people claiming different kinds of rights over various areas of land. Disagreements over the nature and extent of such claims of ownership degenerated into violence and the first "wars".
In some parts of the world, notably Mesopotamia and the Nile valley, natural conditions favoured the concentration of land ownership in few hands. Eventually, a small group of people found themselves owning the land on which many other people worked for a living. This control over the land meant control over the people whose livelihoods depended on the land; thus, the first primitive states arose. These states were usually despotic and unstable, with the ruler(s) holding absolute power over their subjects until some other ruler(s) displaced them. Since there were no laws and no infrastructure, and since power was exercised arbitrarily, some political theorists and historians do not consider such early forms of despotic rule to have been states in the proper sense of the word; they are sometimes called proto-states.
One of the earliest known sets of laws, the Code of Hammurabi, has been dated to ca. 1700 BC. It was around this time that the concept of law - one of the foundations of the modern state - began to appear. But the rulers of the Ancient Near East had a long tradition of holding absolute power and claiming the status of god-kings (see hydraulic despotism). Thus, laws limiting the power of monarchs did not develop very far in that region.
The city-states of Ancient Greece were the first to establish states whose powers were clearly defined in laws (even if the laws themselves could usually be changed quite easily). Also, notably, the idea of democracy was born in ancient Athens (see Athenian democracy).
Many institutions of the modern state (especially in Western Europe and areas once dominated by Western-European empires) can trace their origins back to Ancient Rome, which inherited the political traditions of the Greeks and developed them further (particularly the rule of law, albeit in incomplete form). However, the Roman Republic gave way to the Roman Empire - which, in turn, created the concept of universal empire: the idea that the entire world was (or should be) under the authority of one single legitimate state.
The fall of the Roman Empire and the Great Migrations changed the character of European politics. The "barbarian" (i.e., non-Roman) kingdoms and chieftains that followed the Roman Empire were ephemeral and transitory and bore little resemblance to the modern state. Even the kingdom of Charlemagne was fleeting; without the tradition of primogeniture, it dissolved into three smaller kingdoms with the Treaty of Verdun in 843. These kingdoms were treated more as land holdings by the royalty that ruled them. Once again, the state became little more than an expression of the ruler's private ownership of a certain area of land.
The lack of a real successor to the Roman Empire in Western Europe created a power vacuum. The kingdoms of Western Europe were besieged by invaders on the frontiers - first, the Muslim invasions from the south, then a series of new migrations from the east and finally the Viking invasions from the north. At the same time, the various kingdoms (and smaller political units) were often involved in wars with each other over territory and succession.
The solution that evolved out of these affairs was decidedly opposed to the system of independent states and temporary alliances that dominate the modern international system. Religion, which had rarely been a factor in the power calculations of Ancient Greece and the Roman Empire, became the cornerstone of an extremely loose pan-European defensive bloc under the aegis of the Catholic Church. This system produced an extensive framework of institutions - sometimes called "feudalism" - that regulated internal conflict and enabled Western Europe to confront exterior threats, even while no individual secular entity was truly independent in the sense of the modern state.
This system asserted itself abroad in the form of the Crusades as the Middle Ages progressed. In 1302, Pope Boniface VIII stated that the political powers of Christendom exercised their prerogatives "at the command and sufferance of the priest." This limited the power of kings, who were obliged to pledge their ultimate allegiance to the Pope.
The Holy Roman Empire, one of the strongest medieval authorities, emerged as a competitor to Papal power under Holy Roman Emperor Frederick Barbarossa, who invaded Italy to press his claims to secular authority in the mid-12th century. The weakening of the papacy was a major theme of the Middle Ages; the Western Schism in the later 14th century, a dispute over papal succession, was exploited by secular authorities and contributed to their growing power. The emergence of large, stable land holdings by single dynasties - for instance, France and Castile - enabled them to take a more active and independent role than their traditionally subsidiary role in the earlier middle ages.
This shift to more independent, more secular actors would become a major point of controversy in Early Modern Europe. The great dynasties of Europe dramatically consolidated power by the beginning of the 16th century; additionally, the external threats to Europe had considerably lessened. The Reformation was to have a powerful impact on the structure of European politics; the dispute was not only theological, but also threatened the very fabric of the ancient political institutions of feudalism. The bloody conflicts that followed, blending the religious and political, pitted those who asserted the authority of the Pope (and in Germany, the Holy Roman Emperor) against those who asserted the authority of secular authorities and their sovereign ability to make internal policy, particularly when that policy reflected religious affiliation, Roman Catholic or Protestant.
These conflicts culminated in the Thirty Years' War of the 17th century. In 1648, the powers of Europe signed the Treaty of Westphalia which ended the religious violence for purely political motives and the Church was stripped of temporal power - even though religion continued to play a political role as the foundation of the divine right of kings. The principle of "cuius regio, eius religio" established at Westphalia and previously in the Peace of Augsburg set a precedent of noninterference in other states' internal affairs that was key in the evolution of the modern state. In Germany, the office of the Holy Roman Emperor, the most prominent symbol of lingering institutions of feudalism, was emasculated as a secular authority in favor of the constituent elements of the Holy Roman Empire. The modern state was born.
The state continued to develop as monarchs brought nobles and free towns into line and amassed spectacular resources and prestige. The growing numbers of civil servants eventually became known as the bureaucracy after the elevation of the Republican ideal.
Nearly a century and a half after the Peace of Westphalia, the state became fully modern through the French Revolution. Claiming 'national will' as its justification, Napoleon and the Grande Armee of France swept over Europe. In response, conquered and neighboring principalities discarded their old systems and adopted the new model of the nation state. The nation state has remained the dominant political entity all over the world ever since, even though the many ideologies of the 19th and 20th century have created numerous different ways of running the affairs of nation states, as well as numerous different forms of internal and external organization (see political system and economic system).
International point of view
The legal criteria for statehood are not obvious. A document that is often quoted on the matter is the Montevideo Convention from 1933, the first article of which states:
:The state as a person of international law should possess the following qualifications: (a) a permanent population; (b) a defined territory; (c) government; and (d) capacity to enter into relations with the other states.
Also, in article 3 it very clearly states that statehood is independent of recognition by other states. This is the declarative theory of statehood. While the Montevideo is a regional American convention and has no legal effect outside the Americas, some have nonetheless seen it as an accurate statement of customary international law.
On the other hand, article 3 of the convention is attacked by the advocates of the constitutive theory of statehood, where a state exists only insofar as it is recognized by other states. Which theory is correct is a controversial issue in international law. An example in practice was the collapse of central government in Somalia in the early 1990s: the Montevideo convention would imply that the state of Somalia no longer existed, and the subsequently declared republic of Somaliland (comprising part of the so-called "former" Somalia) may meet the criteria for statehood. However the self-declared republic has not achieved recognition by other states.
Article 1 of the convention is also attacked by those who claim that it fails to take into account the complicated situations of military occupation, territorial cession, and governments in exile. Richard W. Hartzell is a leading proponent of this view, and stresses that the four criteria of article 1 need to be expanded to nine. The domestic point of view
Looked at from the point of view of an individual nation, the state is a centralized organization of the whole country. Those studying this dimension emphasize the relationship between the state and its people. The English political philosopher Thomas Hobbes argued that in order to avoid a multi-sided civil war, in which life was "solitary, poor, nasty, brutish, and short", individuals must necessarily surrender many of their "natural rights" -- including that of attacking each other -- to the "Leviathan", a unified and centralized state. In this tradition, Max Weber and Norbert Elias defined the state as an organization of people that has a monopoly on the legitimate use of force in a particular geographic area. Also in this tradition, the state differs from the "government": the latter refers to the group of people who make decisions for the state.
For Weber, this was an "ideal type", or model, or pure case of the state. Many institutions that have been called "states" do not live up to this definition. For example, in countries such as Afghanistan and the Democratic Republic of the Congo, the central state has so far not succeeded in monopolizing the legitimate use of force, and must compete with various local warlords. These cases are sometimes called "failed states".
One of the most basic characteristics of a modern state is regulation of property rights, investment, trade and the commodity markets (in food, fuel, etc.) typically using its own currency. Although many states (by their own decision) increasingly cede these powers to trade bloc entities, e.g. North American Free Trade Agreement, European Union, it is always controversial to do so, and opens the question of whether these blocs are in fact simply larger states. The study of political economy, which evolved into the modern study of economics, deals with these specific questions in more detail.
However, although states are often influenced in their decisions and no longer hold an absolute jurisdiction over their internal affairs, they are nonetheless much stronger in relation to international organizations or to other states than lower (substate) political subdivisions normally are. But the trend at the moment is for the power of superstate levels of governance to increase, and there is no sign of this increase abating. Many (especially those who favour constitutional theories of international law) therefore reject as outdated the idea of sovereignty, and view the state as just the chief political subdivision of the planet.
Philosophies of the state
Different political philosophies have distinct opinions concerning the state as a domestic organization. In the modern era, these philosophies emerged with the rise of capitalism, which coincided with the (re)emergence of the state as a separate and centralized sector of society. Philosophers such as Thomas Hobbes, John Locke, and Jean-Jacques Rousseau pondered issues concerning the ideal and actual roles of the state. Recent philosophers like John Rawls and Robert Nozick were more concerned with distributive justice and the morality of exercising political power.
There are four theories about the origin (and indirectly the justification) of the state. They are:
- Supernatural or natural authority - In this view, the state is either ordained by a higher power (such as God for the "Divine right of kings") or arises naturally out of a presumed human need for order and authority.
- Natural rights - According to this theory, human beings have certain rights that are "natural" (the implications of this word may vary), and establish states for the protection of those rights.
- Social contract - This idea holds that the state is established by the people (i.e. through the consent of the governed) in order to provide for various collective needs that cannot be satisfied through individual efforts, such as national defense, public roads, education, "the general welfare", etc.
- Conflict - Perhaps the simplest of the theories, it holds that the state did not arise out of any conscious decision, but merely as the result of violent conflict. Various groups of people fought each other for control over land or other resources, and the winning side imposed its domination on the losing side.
These four theories can accommodate the full spectrum of political views. In practice, most people (and most political philosophies) subscribe to a combination of two or more of the above theories - arguing, for example, that different states have different origins. The conflict theory, in particular, is often combined with one of the other three in order to separate the illegitimate states (those created through conflict and subjugation) from the legitimate ones.
There are at least five major philosophies of the state today, the last four of which correspond to specific political ideologies: contractarianism, liberalism, Marxism, conservatism, and anarchism.
Contractarianism, as the name implies, is based on the social contract theory. It is also the only major philosophy of the state that does not fall within any single political ideology - perhaps because several different ideologies have adopted it as their own. Contractarianism is the foundation of modern democracy, as well as most forms of socialism and some types of liberalism. In contractarian thinking, the state should express the public interest, the interests of the whole society, and reconcile it with the separate interests of individuals. The state provides public goods and other kinds of collective consumption, while preventing individuals from free-riding (taking advantage of collective consumption without paying) by forcing them to pay taxes.
Liberalism, in the classical sense, is based mainly on the natural rights theory. In this view, some or even all "rights" exist naturally and are not created by the state. For example, John Locke believed that individual property rights existed prior to the creation of the state, while the state's main job should be to preserve those rights. Historically, liberals have been less concerned with determining what the state should do and far more interested in stipulating what the state shouldn't do. The liberal philosophy of the state holds that the powers of any state are restricted by natural rights that exist independently of the human mind and overrule any social contract. However, there has been considerable debate among liberals as to what these natural rights actually are. Critics argue that they do not exist at all, since they are not evident from any observations of nature.
On the other hand, there are also liberals who subscribe to the contractarian theory. In most cases, they fall on the left wing of liberalism, being social liberals ("New Deal" liberals; see American liberalism) and arguing for a welfare state. They stand in opposition to adherents of the natural rights theory, who tend to be libertarians, falling on the right wing of liberalism and arguing for a "minimal" state.
The Marxist philosophy of the state is based on the conflict theory - specifically, on the idea of class conflict. In this view, the primary role of the state in practice is to enforce the existing system of unequal property and personal rights, class domination, and exploitation. The state also mediates in all types of social conflicts, and supplies necessary social-infrastructural conditions for society as a whole. Under such systems as feudalism, the lords used their own military force to exploit their vassals. Under capitalism, on the other hand, the use of force is centralized in a specialized organization which protects the capitalists' class monopoly of ownership of the means of production, allowing the exploitation of those without such ownership. In modern Marxian theory, such class domination can coincide with other forms of domination (such as patriarchy and ethnic hierarchies).
Further, in Marxist theory, classes and other forms of exploitation should be abolished by establishing a socialist system, to be followed later by a communist one. Communism, the final goal, is a classless, propertyless and stateless society; however, socialism still preserves personal property and a (democratic) state. Thus, Marxism is opposed to the state (which it views as illegitimate, in accordance with the conflict theory), but does not wish to abolish the state immediately. As such, there is some overlap between Marxism and contractarianism: the socialist state that Marxists wish to establish as their short-term goal is to be based on a form of social contract. This state ought subsequently to slowly "wither away" as the representative democracy of socialism gradually transforms into the direct democracy of communism. Once the process is complete, the communist social order has been achieved and the state no longer exists as an entity separate from the people.
In conservative thinking, which is based on the theory of (super)natural authority, the existing structure of traditions and hierarchies (of class, patriarchy, ethnic dominance, etc.) is seen as benefiting society overall. Thus, in a way, conservatives accept some ideas from both the Marxist and the liberal schools of thought, but view them in a different light: the state forces people to accept class and other kinds of domination, but this is seen as being for their own good. This perspective posits that, in general, current traditions only exist because they have been demonstrably successful in the past. Further, as with the liberals, the state is seen as always existing and/or "natural". Many conservatives, especially in recent decades, have come out in favor of the liberal theory of natural rights.
Finally, in anarchist thinking, the state is nothing but an unnecessary and exploitative segment of society. Totally rejecting the Hobbesian notion that only a state can prevent chaos, anarchists argue that the state's monopoly of violence creates chaos. They believe that if the state and its restrictions on individual freedom were abolished, people could figure out how to work together peacefully and individual creativity would be unleashed. Contrary to the Marxist perspective, the anarchists see the state as an unnecessary evil, rather than a tool to be used in the class struggle.

U.S. States
A U.S. state is any one of the fifty states (four of which officially favor the term commonwealth) which, together with the District of Columbia and Palmyra Atoll (an uninhabited incorporated unorganized territory), form the United States of America. The separate state governments and the U.S. federal government share sovereignty, in that an "American" is a citizen both of the federal entity and of his or her state of residence.
The United States Constitution allocates power between the two levels of government in general terms; the general idea is that by ratifying the Constitution, each state has transferred certain aspects of its sovereign powers to the federal government while retaining the remainder for itself. The tasks of education, health, transportation, and other infrastructure are generally the responsibility of the states.
Over time, the Constitution has been amended, and the interpretation and application of its provisions have changed. The general tendency has been toward centralization, with the federal government playing a much larger role than it once did.
Legal relationship
At the time of the Declaration of Independence from Great Britain in 1776, the 13 colonies became 13 independently sovereign states, which became fourteen in 1777 with the formation of the Vermont Republic; for a brief period, they were in effect legally separate nations. But upon the adoption of the Articles of Confederation and Perpetual Union, the states became a single sovereign political entity as defined by international law, empowered to levy war and to conduct international relations, albeit with a very loosely structured and inefficient central government. After the failure of the union under the Articles of Confederation, the thirteen states joined the modern union via ratification of the United States Constitution, beginning in 1789.
Under Article IV of the Constitution, which outlines the relationship between the states, the Congress has the power to admit new states to the union. The states are required to give "full faith and credit" to the acts of each other's legislatures and courts, which is generally held to include the recognition of legal contracts, marriages, criminal judgments, and - at the time - slave status. The states are guaranteed military and civil defense by the federal government, which is also required to ensure that the government of each state remains a republic.
The Constitution is silent on the issue of the secession of a state from the union. The Articles of Confederation had stated that the earlier union of the colonies "shall be perpetual", and the preamble to the Constitution states that Constitution was intended to "form a more perfect union". In 1860 and 1861, several states attempted to secede, but were brought back into the Union by force of arms during the Civil War. Subsequently, the federal judicial system, in the case of Texas v. White, established that states do not have the right to secede without the consent of the other states.
- Four of the states bear the formal title of Commonwealth: Kentucky, Massachusetts, Pennsylvania, and Virginia. In these cases, this is merely a name and has no legal effect. However, the United States has non-state areas called commonwealths (Puerto Rico and the Northern Marianas) which do have a legal status different from the states.
- States are free to organize their judicial systems differently from the federal judiciary, as long as due process is protected. See state supreme court for more information. For example, most lawsuits in the state of New York are filed in the Supreme Court, and then appealed to the Appellate Division of the Supreme Court. The highest court in New York is the Court of Appeals.
- The joint resolution which admitted the Republic of Texas to the Union as a state guaranteed Texas the right to divide itself up into up to 5 states. This clause may be redundant, however, as any such state would arguably require Congressional approval, just as when Maine was split off from Massachusetts; it may also be unconstitutional, as reducing the equal suffrage of the other states in the United States Senate.

State names speak to the circumstances of their creation. (See the lists of U.S. state name etymologies and U.S. county name etymologies for more detail.)
- Southern states on the Atlantic coast originated as British colonies named after British monarchs: Georgia, the Carolinas, Virginia, and Maryland. Some northeastern states, also former British colonies, take their names from places in the British Isles: New Hampshire, New Jersey, New York.
- Many states' names are those of Native American tribes or are from Native American languages: Kansas, Massachusetts, Hawaii, Connecticut, Missouri, Iowa, Wisconsin, Illinois, Minnesota, the Dakotas, Mississippi, Texas, Utah, and others.
- Because they are on territories previously controlled by Spain or Mexico, many states in the southeast and southwest have Spanish names. They include Colorado, New Mexico, Florida, and Nevada.
- Because it was previously a French colony, Louisiana is named after the Louis XIV (King of France at the time).
- The origins of the names of California, Oregon, Idaho, and Rhode Island are unknown, although various theories exist.
Trivia
Names
- "Georgia" can refer to either a U.S. state or to an independent country in the Caucasus.
- The name "New York" can refer to any one of three geographical levels: a state, a city in that state, or a county (coterminous with the borough of Manhattan) in that city.
- "Washington" is a state, a city corresponding to the District of Columbia (and thus not part of any state), and a number of cities and counties in various states. See the list of places named for George Washington.
- The state of Washington is the only state named after a U.S. President (or after a person born within the area now comprising the U.S., for that matter).
- The official name of Rhode Island is "the State of Rhode Island and Providence Plantations."
- Only two states have state capitals named for the state (however, such name-sharing occurs commonly with states and provinces in some other countries, where the state or province actually often takes its name from a capital city): Oklahoma, with capital Oklahoma City, and Indiana, with capital Indianapolis (which means Indiana City). Iowa City, Iowa was the first state capital of Iowa but the capital was later moved to Des Moines, Iowa.
- Maine is the only state with a one-syllable name.
Geography
- Colorado and Wyoming are bounded by two circles of latitude and two meridians each, i.e. they appear to be rectangles in a cylindrical map projection.
- Colorado, Utah, and Wyoming are the only states whose borders are made up of only straight lines (taking meridians and circles of latitude as straight lines) and, thus, the only states whose borders completely ignore natural features.
- Every state—except Hawaii, which has no land boundaries—has straight lines as at least part of its boundaries. These are usually combined with rivers (see river borders of U.S. states), ridge lines and other natural boundaries. Pennsylvania and Delaware are unique in that their common border is an arc of a circle, see The Twelve-Mile Circle.
- The lower peninsula of Michigan is shaped like a mitten; Louisiana is shaped like a boot.
- Alaska, Florida, Idaho, Maryland, Nebraska, Oklahoma, Texas and West Virginia have panhandles.
- Alabama, Missouri, New Mexico and Mississippi have bootheels.
- Alaska and Hawaii are the only states that are not physically connected to other states; Maine is the only state that borders only one other state. Missouri and Tennessee each border eight other states, the most for any state.
- Arizona, New Mexico, Colorado, and Utah are the only four states to share a common border, known as the "Four Corners."
- Appearances given by the stereographic projection to the contrary, Minnesota is the northernmost of the forty-eight contiguous United States, as a northern spur of the state contains a portion of Lake of the Woods. At one time it was thought that Lake of the Woods contained the headwaters of the Mississippi River (now known to be at Lake Itasca).
- Alaska is the northernmost state and the westernmost state. Some would argue that it is also the easternmost state, as the Aleutian island chain crosses the 180º line of longitude.
